Most GTA homeowners don’t know their legal exposure during a renovation. Here’s the 2026 safety and liability guide.
WSIB exposure — the biggest unknown risk:
If a worker is injured on your property and the contractor is NOT properly WSIB-registered, you may be personally liable for their medical costs and lost income. This is Ontario law, not theory.
Protection: Obtain a WSIB clearance certificate for every contractor before work begins. Verify it at wsib.ca/certificate — don’t accept a photocopied certificate without online verification. The clearance must be current (certificates expire).
Property damage liability:
If a contractor causes damage to your home or neighbouring properties — water damage from a plumbing error, structural damage from excavation — their general liability insurance is the primary remedy. Without it, you may have no recourse beyond small claims court.
Required: Certificate of Insurance showing $2M+ general liability. Named as additional insured.
Your own insurance:
Standard home policies frequently reduce or eliminate coverage during major construction. Notification requirement: tell your insurer BEFORE work starts. Get written confirmation of continued coverage or a renovation endorsement.
The indemnification clause:
Your contract should include language where the contractor holds you harmless from claims arising from their work and their subcontractors’ work. Standard in professional contracts; absent in casual arrangements.
