Ontario Fence and Retaining Wall Guide 2026 - Permits, Heights and Line Fence Rules

Fences and retaining walls are among the most common sources of neighbour disputes and bylaw violations in the GTA. This covers Ontario’s Line Fences Act, municipal height bylaws, permit requirements, and 2026 contractor costs.

Ontario Line Fences Act

The Line Fences Act governs boundary fences in Ontario. Both neighbours share equally in the cost of a line fence unless one party waives the right. Disputes go to municipal fence viewers for arbitration.

Note: The Act does NOT apply in municipalities with their own fence bylaws — most GTA municipalities have passed such bylaws. Check your local bylaw first.

Municipal Height Limits (GTA)

Toronto: Maximum 2.0m rear/side yard, 1.0m front yard.
Mississauga: Maximum 2.1m rear yard, 0.9m front yard.
Most GTA: Front yards more restricted than rear. Corner lot sight-line triangles must be maintained at driveways and intersections.

Retaining Wall Permit Requirements

Walls over 1.0m (3.3 ft) require building permit in most Ontario municipalities. Structural engineer drawings required for taller walls. Surcharge from structures within H/2 of wall height must be included in engineering analysis.

Cost Ranges (GTA 2026)

  • Wood fence (pressure-treated): $30-$55/linear ft installed
  • Vinyl fence: $35-$65/linear ft installed
  • Aluminum fence: $45-$80/linear ft installed
  • Interlock/stone retaining wall (under 1m): $60-$120/linear ft
  • Engineered concrete retaining wall (over 1m): $150-$350/linear ft with engineering
