Getting conflicting info from neighbours about permit requirements for my planned deck + pergola project. Spent a few hours researching across several GTA municipality websites - here is what I found.
The Provincial Baseline
Ontario Building Code says structures under 10 sq m (107 sq ft) on a 1-2 storey residence may be exempt from permits. But municipalities can be more restrictive than this provincial minimum.
What I Found Per Municipality
Toronto: Decks over 0.6m (24") above grade require a building permit regardless of size. Freestanding structures under 10 sq m may be exempt. Attached structures (pergola attached to house) require permit.
Mississauga: Same threshold - decks over 600mm need permit. Structures attached to house need permit.
Brampton: Decks over 300mm (1 foot) above grade require permit - more restrictive than provincial baseline.
Markham: Permit required for decks above 600mm. All structures attached to house require permit.
Setbacks: Critical Even for No-Permit Structures
Even if your structure does not require a permit, you must comply with zoning setbacks. Rear yard setbacks are typically 1.2m-3m from the property line in GTA suburbs. Side yard setbacks are often tighter. Build inside your setbacks or get a zoning variance.
My Situation
12x16 ft deck (1.8m above grade at highest point) + attached pergola. This requires a permit in every GTA municipality. Budget: $300-$700 for permits, 3-6 weeks wait for approval.
Advice
Do not skip permits on deck projects. Insurance companies are denying claims on unpermitted structures. Re-sale inspectors flag them. The cost of retroactive permits or demolition is far worse than doing it right the first time.
